These Terms of Service ("Terms") govern your use of the MonsoonOS platform and related services provided by Cactus Wash Systems LLC("we," "us," or "our"). By accessing or using our services, you agree to these Terms.

1. Services

MonsoonOS is management software for self-service car wash and dog wash businesses. We provide tools for equipment control, payment processing, customer management, and business analytics.

2. Account Registration

To use the platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account.

3. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the platform
  • Interfere with or disrupt the platform or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the software
  • Use the platform to transmit malicious code or content

4. Payment Terms

Subscription fees are billed according to the plan you select. Payments are processed through Stripe. You authorize us to charge your payment method for recurring fees. Refund policies are outlined in your service agreement.

5. Intellectual Property

The MonsoonOS platform, including its software, design, and documentation, is owned by Cactus Wash Systems LLC. You retain ownership of your data. We grant you a limited, non-exclusive license to use the platform for its intended purpose.

6. Data and Privacy

Your use of the platform is also governed by our Privacy Policy. You are responsible for the data you upload and for compliance with applicable data protection laws.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify you of planned downtime.

8. Limitation of Liability

To the maximum extent permitted by law, Cactus Wash Systems LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Termination

Either party may terminate the service agreement with written notice. Upon termination, your access to the platform will be revoked and your data will be retained for 30 days before deletion, unless otherwise required by law.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on our website. Continued use of the platform after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
